Leave Donation Policy

Section 1: Purpose
1.1 The purpose of this policy is to establish a sick leave
donation program to provide full time, non-probationary employees a more
extensive sick leave plan to use in the event of a non-occupational
catastrophic personal or immediate family illness, injury, or temporary
disability. Catastrophic illness or
injury is defined as an illness or injury that requires a leave of absence from
work of more than fifteen (15) consecutive work days.
Section 2: Definition
2.1 Immediate family is father, mother,
spouse, son, daughter, or ward.
Section 3: Eligibility
3.1
An
employee requesting donation of sick leave hours must (a) have completed six
(6) consecutive months of employment, (b) have an absence due to a
non-occupational, personal or immediate family illness or disability for which
they have medical documentation (medical documentation must be provided at the
time donations are requested and at anytime thereafter as required), (c) have
exhausted all sick leave and annual leave hours.
Section 4: Requirements for
Donation of Leave
4.1
An
employee requesting the donation of leave must meet all requirements of
eligibility as listed in Section 3.
4.2
An
employee requesting the donation of leave must first submit a written request
to the County Commissioners Office including (a) a current medical statement
with a diagnosis of the personal or immediate family member’s illness and (b)
an expected return date to work. If an
employee is physically or mentally unable to make a request for leave donation,
a family member or designee may file the request, with proper documentation, on
the employee’s behalf.
4.3
An
employee wishing to donate leave hours to another employee must submit the
donation of leave in writing to the County Commissioners Office specifying how
many hours of sick leave they wish to donate and to whom they wish to donate
this time.
4.4
As
stated in the personnel policy, no employee can accrue more than 480 hours of
sick leave, including donated leave.
4.5
An
employee can donate sick leave in increments of eight (8) hours (one full work
day) only.
4.6
An
employee donating sick leave hours cannot donate an amount which will cause the
donating employee’s sick leave balance to fall below 40 hours of accrued sick
leave.
4.7
An
employee’s donated hours will be computed based on their dollar value, and
conversions will be made based on the pay rates of the requesting employee and
the donating employee. For example, if
the employee requesting leave is presently making $20.00 per hour and the
employee donating leave is making $10.00 per hour, donating 80 hours of sick
leave would equate to 40 hours being received by the requesting employee. In order to calculate, multiply the hourly
rate of the donating employee times the number of hours being donated and
divide that amount by the receiving employee’s hourly rate to give the number
of hours being received from the donation.
4.8
When
an employee receives more hours than needed, upon returning to work, the balance
of donated hours remaining will revert back to the donors on a percentage given
basis.
4.9
The
donation of leave to an employee eligible of receiving it is completely
voluntary by each employee and is up to his/her discretion whether to
donate. No employee shall threaten,
coerce, or attempt to threaten or coerce another employee for the purpose of
interfering with rights involving leave donation, receipt of leave donation, or
the use of donated leave.
4.10
An
employee who is resigning or retiring from his or her position shall not be
allowed to donate their leave time to an eligible employee.
4.11
If an
employee was granted donated leave and it was found the employee received such
leave on the basis of mis-stated, erroneous, or false statements, the employee
will be required to reimburse the donated leave.
